Neighbour Matters
Party Wall Matters
The Party Wall etc Act 1996 applies to England & Wales. Its purpose is to provide obligations on building owners of domestic and non-domestic buildings or structures carrying out certain works or operations that affect adjoining owners.
The Act allows work to progress swiftly after adjoining owners have been notified.
If a dispute arises between owners, the Act provides mechanisms through dispute resolution by appointing suitably qualified surveyors.
At Urbanheyes we provide advice on all Party Wall Matters.
To achieve this we;
- Identify the building elements of the proposed works which fall within the scope of the Act
- Undertake Surveys to Prepare Schedule of Conditions
- Identify and advise statutory obligations of building owners
- Identify ownership rights of adjoining owners
- Prepare and Serve Notices
- Prepare, Agree and Complete Schedules and Party Wall Awards
- Check and Agree Schedules and Awards
- Negotiate Terms of Party Wall Awards
Boundary Disputes
Boundary Disputes occur in all kinds of scenarios, however the majority are within suburban locations within residential neighbourhoods. Most can be avoided but some need to be settled with expert advice and guidance.
Most disputes occur on fences, walls, hedges but could easily involve proposed extensions. Problems arise when one neighbour disputes where the legal property boundary is situated.
At Urbanheyes we can carry out this service, dealing with either one neighbour or several (depending on instruction) to resolve the location of the boundary.
To achieve this we;
- Locate and Examine Deed Plans.
- Assess Current Plans and Historic Plans.
- Agree or Negotiate with Neighbours or their Surveyors.
- Advise on relevant Legislation.
